Depuis lors, aucune autorit\u00e9 responsable n'a agi pour mettre fin, ou m\u00eame enqu\u00eater, sur la torture et la n\u00e9gligence m\u00e9dicale de M. Assange. Au lieu de cela, les actions en cours des \u00c9tats-Unis (US) et du Royaume-Uni (UK), et l'inaction de l'Australie, ont perp\u00e9tu\u00e9 et intensifi\u00e9 la campagne de pers\u00e9cution collective et de harc\u00e8lement judiciaire responsable de la torture de M. Assange, telle qu'identifi\u00e9e par le professeur Nils Melzer, le rapporteur sp\u00e9cial des Nations unies sur la torture et autres peines ou traitements cruels, inhumains ou d\u00e9gradants (\u003Ca href=\"#nb2\" name=\"nh2\"\u003E2\u003C\/a\u003E).\u003C\/p\u003E\u003Cp\u003ECela fait maintenant plus d'un an que deux experts m\u00e9dicaux sp\u00e9cialis\u00e9s dans l'\u00e9valuation et la documentation de la torture ont accompagn\u00e9 le professeur Melzer pour rendre visite \u00e0 M. Assange \u00e0 la prison de Sa Majest\u00e9 (HMP) de Belmarsh, \u00e0 Londres. Cette \u00e9quipe a rapport\u00e9 en mai 2019 que M. Assange pr\u00e9sentait tous les sympt\u00f4mes typiques d'une personne soumise \u00e0 une torture psychologique prolong\u00e9e. Le professeur Melzer souligne en outre que la torture psychologique n'est pas une \"torture l\u00e9g\u00e8re\" et qu'elle vise directement \u00e0 d\u00e9truire la personnalit\u00e9 d'un individu (\u003Ca href=\"#nh2\" name=\"nb2\"\u003E2\u003C\/a\u003E). Dans ses rapports et d\u00e9clarations, le professeur Melzer a \u00e9t\u00e9 cat\u00e9gorique quant \u00e0 la source de cette torture\u00a0: les actions combin\u00e9es des gouvernements des \u00c9tats-Unis, du Royaume-Uni, de la Su\u00e8de et de l'\u00c9quateur. Il a lanc\u00e9 un nouvel avertissement selon lequel les conditions inhumaines de d\u00e9tention de M. Assange \u00e0 Belmarsh pourraient bient\u00f4t lui co\u00fbter la vie (\u003Ca href=\"#nh2\" name=\"nb2\"\u003E2\u003C\/a\u003E).\u003C\/p\u003E\u003Cp\u003ED'un point de vue m\u00e9dical, les risques pour la vie et la sant\u00e9 de M. Assange n'ont fait que s'aggraver depuis les avertissements du professeur Melzer, et ce pour deux raisons principales. La premi\u00e8re est que les droits fondamentaux de M. Assange continuent d'\u00eatre bafou\u00e9s par les autorit\u00e9s judiciaires, p\u00e9nitentiaires et de s\u00e9curit\u00e9 pendant sa proc\u00e9dure d'extradition. La seconde concerne les graves risques m\u00e9dicaux encourus par les prisonniers vuln\u00e9rables lors de l'urgence sanitaire mondiale COVID-19, et l'exacerbation de la torture psychologique de M. Assange dans le cadre des mesures de verrouillage des prisons COVID-19.\u003C\/p\u003E\u003Cp\u003E\u003Cb\u003EFormes d'abus constituant des actes de torture.\u003C\/b\u003E\u003C\/p\u003E\u003Cp\u003EDepuis notre pr\u00e9c\u00e9dente lettre, M. Assange a fait l'objet de six audiences judiciaires (24-27 f\u00e9vrier, 25 mars, 7 avril, 27 avril, 4 mai et 1er juin), qui font partie de notre chronologie d\u00e9taill\u00e9e des \u00e9v\u00e9nements fournie (TABLEAU 2).\u003C\/p\u003E\u003Cp\u003ELe traitement r\u00e9serv\u00e9 \u00e0 M. Assange durant la premi\u00e8re phase de sa proc\u00e9dure d'extradition en f\u00e9vrier a \u00e9t\u00e9 qualifi\u00e9 de \"choquant et excessif\" par l'Institut des droits de l'homme de l'Association internationale du barreau (IBAHRI), qui a compar\u00e9 les abus \u00e0 ceux du scandale de la prison d'Abou Ghraib (\u003Ca href=\"#nb3\" name=\"nh3\"\u003E3\u003C\/a\u003E).\u003C\/p\u003E\u003Cp\u003ETout au long de ces audiences et des suivantes, M. Assange n'a pas pu assurer sa propre d\u00e9fense. Il a \u00e9t\u00e9 d\u00e9tenu dans une enceinte de verre pare-balles au fond de la salle d'audience (4\u00a0;5) pendant les quatre jours de la proc\u00e9dure d'extradition, et a object\u00e9 \u00e0 plusieurs reprises que, par cons\u00e9quent, il ne pouvait pas entendre la proc\u00e9dure ni communiquer avec ses avocats et leur donner des instructions. En r\u00e9ponse \u00e0 une demande formelle des avocats de M. Assange, le juge a refus\u00e9 \u00e0 ce dernier l'autorisation de quitter l'enceinte pour s'asseoir avec eux, malgr\u00e9 l'assentiment des avocats du minist\u00e8re public \u00e0 cette demande (\u003Ca href=\"#nb6\" name=\"nh6\"\u003E6\u003C\/a\u003E).\u003C\/p\u003E\u003Cp\u003ELorsqu'il est retourn\u00e9 \u00e0 Belmarsh apr\u00e8s le premier jour de l'audience d'extradition, les autorit\u00e9s p\u00e9nitentiaires ont fouill\u00e9 M. Assange \u00e0 deux reprises, l'ont menott\u00e9 \u00e0 onze reprises et l'ont transf\u00e9r\u00e9 successivement dans cinq cellules de d\u00e9tention diff\u00e9rentes (4\u00a0;7\u00a0;8). Les documents judiciaires de M. Assange ont \u00e9galement \u00e9t\u00e9 saisis, y compris les communications entre clients et avocats, qui sont l\u00e9galement confidentielles.\u003C\/p\u003E\u003Cp\u003EPar la suite, M. Assange n'a assist\u00e9 qu'\u00e0 une seule des cinq audiences suivantes, et ce par liaison vid\u00e9o. La liaison vid\u00e9o a \u00e9t\u00e9 interrompue avant la fin de l'audience. Depuis, M. Assange a manqu\u00e9 quatre des audiences suivantes en raison des restrictions li\u00e9es \u00e0 la COVID-19 et des risques m\u00e9dicaux. Il n'a pas \u00e9t\u00e9 vu au tribunal, ni en personne ni par liaison vid\u00e9o, depuis le 25 mars 2020. En outre, la deuxi\u00e8me phase de sa proc\u00e9dure d'extradition \u00e9tant imminente, le verrouillage des prisons britanniques en raison de COVID-19 a fait dispara\u00eetre les visites en prison (9\u00a0;10), emp\u00eachant M. Assange de rencontrer ses avocats pour pr\u00e9parer les futures proc\u00e9dures.\u003C\/p\u003E\u003Cp\u003EDans une autre action visant \u00e0 le priver de ses protections, le juge a lev\u00e9 une ordonnance d'anonymat, malgr\u00e9 les objections des avocats de M. Assange, lors d'une audience d'urgence sur la mise en libert\u00e9 sous caution \u00e0 la lumi\u00e8re de COVID-19. Cette ordonnance avait \u00e9t\u00e9 mise en place pour prot\u00e9ger la vie priv\u00e9e de la fianc\u00e9e de M. Assange, Stella Morris, et de leurs deux enfants (11\u00a0;12). Peu avant que la protection accord\u00e9e par l'ordonnance du tribunal ne soit lev\u00e9e, Mme Morris a rendu publique l'histoire de leur famille.\u003C\/p\u003E\u003Cp\u003ECes \u00e9v\u00e9nements et d'autres ont intensifi\u00e9 le sch\u00e9ma d'irr\u00e9gularit\u00e9s et d'exc\u00e8s document\u00e9 par le professeur Melzer, provoquant une escalade dans l'impuissance impos\u00e9e, l'arbitraire, la menace et l'isolement, tous des \u00e9l\u00e9ments cl\u00e9s de la torture psychologique de M. Assange.\u003C\/p\u003E\u003Cp\u003E\u003Cb\u003EPand\u00e9mie COVID-19.\u003C\/b\u003E\u003C\/p\u003E\u003Cp\u003ECompte tenu de la propagation rapide de COVID-19 au Royaume-Uni, les prisons servant de \"vivier\" pour les maladies infectieuses, M. Assange court un risque grave de contracter et de succomber au coronavirus. Sur le plan m\u00e9dical, il faut supposer que le risque est bien plus \u00e9lev\u00e9 que celui de la population carc\u00e9rale g\u00e9n\u00e9rale, en raison de son \u00e9tat respiratoire chronique et de ses ant\u00e9c\u00e9dents de torture psychologique et de n\u00e9gligence m\u00e9dicale, ce qui entra\u00eene une forte probabilit\u00e9 que son syst\u00e8me immunitaire soit gravement compromis. En outre, M. Assange est non-violent, il est en d\u00e9tention pr\u00e9ventive, il ne purge pas une peine pour un crime et il est d\u00e9tenu arbitrairement selon le groupe de travail des Nations unies sur la d\u00e9tention arbitraire (\u003Ca href=\"#nb13\" name=\"nh13\"\u003E13\u003C\/a\u003E). Ainsi, il r\u00e9pond aux crit\u00e8res de lib\u00e9ration des prisonniers recommand\u00e9s au niveau international par les associations de d\u00e9fense des droits de l'homme et des avocats pour contenir la propagation de COVID-19 et prot\u00e9ger les personnes vuln\u00e9rables (14-16). En cons\u00e9quence, un plan de lib\u00e9ration sous caution a \u00e9t\u00e9 pr\u00e9sent\u00e9 au tribunal, impliquant une d\u00e9tention \u00e0 domicile surveill\u00e9e pour M. Assange, avec sa fianc\u00e9e et leurs enfants.\u003C\/p\u003E\u003Cp\u003EN\u00e9anmoins, le juge de district Vanessa Baraitser a refus\u00e9 la mise en libert\u00e9 sous caution de M. Assange. Cette d\u00e9cision, comme nous l'avons d\u00e9clar\u00e9 \u00e0 l'issue de l'audience sur la mise en libert\u00e9 sous caution (\u003Ca href=\"#nb17\" name=\"nh17\"\u003E17\u003C\/a\u003E), a eu pour cons\u00e9quence que M. Assange est maintenu en isolement cellulaire pendant 23 heures par jour (\u003Ca href=\"#nb18\" name=\"nh18\"\u003E18\u003C\/a\u003E). Il s'est \u00e9galement vu refuser une radio pendant plusieurs mois. Ayant d'abord command\u00e9 une radio dans le catalogue de la prison il y a six mois, et apr\u00e8s qu'un ami de M. Assange ait tent\u00e9 de lui en envoyer une, et qui lui a \u00e9t\u00e9 retourn\u00e9e, M. Assange a re\u00e7u une radio le 16 juin 2020 (\u003Ca href=\"#nb19\" name=\"nh19\"\u003E19\u003C\/a\u003E). L'isolement et la sous-stimulation sont des tactiques de torture psychologique essentielles, capables d'induire un d\u00e9sespoir profond, une d\u00e9sorientation, une d\u00e9stabilisation et une d\u00e9sint\u00e9gration de fonctions mentales et psychologiques cruciales (\u003Ca href=\"#nb20\" name=\"nh20\"\u003E20\u003C\/a\u003E).\u003C\/p\u003E\u003Cp\u003EEn tant que personne incarc\u00e9r\u00e9e uniquement pour son activit\u00e9 d'\u00e9diteur, continuer \u00e0 d\u00e9tenir M. Assange dans ces conditions repr\u00e9sente la torture d'un \u00e9diteur et d'un journaliste. Dans le contexte des attaques et des arrestations de journalistes lors des r\u00e9centes manifestations mondiales, son traitement et le pr\u00e9c\u00e9dent qu'il cr\u00e9e sont une source de pr\u00e9occupation internationale.\u003C\/p\u003E\u003Cp\u003E\u003Cb\u003EAppel \u00e0 l'action\u003C\/b\u003E.\u003C\/p\u003E\u003Cp\u003ENous avons assist\u00e9 \u00e0 ces \u00e9v\u00e9nements avec inqui\u00e9tude. Depuis notre lettre de f\u00e9vrier, plusieurs organisations de d\u00e9fense des droits de l'homme ont ajout\u00e9 leur voix aux appels internationaux en faveur de la lib\u00e9ration de M. Assange et \u00e0 la condamnation (21-25) de la proc\u00e9dure d'extradition. Amnesty International, qui avait pr\u00e9c\u00e9demment demand\u00e9 aux \u00c9tats-Unis de renoncer \u00e0 leurs accusations d'espionnage (\u003Ca href=\"#nb14\" name=\"nh14\"\u003E14\u003C\/a\u003E), a plaid\u00e9 pour la lib\u00e9ration sous caution de M. Assange avant son audience d'urgence (\u003Ca href=\"#nb26\" name=\"nh26\"\u003E26\u003C\/a\u003E). En outre, le 20 mars, le Conseil de l'Europe a relev\u00e9 son \"niveau de menace\" dans le cas de M. Assange, qu'il consid\u00e8re comme la d\u00e9tention et l'emprisonnement d'un journaliste, au niveau 1 (\u003Ca href=\"#nb27\" name=\"nh27\"\u003E27\u003C\/a\u003E), r\u00e9serv\u00e9 aux \"... violations les plus graves et les plus pr\u00e9judiciables de la libert\u00e9 des m\u00e9dias\" (\u003Ca href=\"#nb28\" name=\"nh28\"\u003E28\u003C\/a\u003E).\u003C\/p\u003E\u003Cp\u003ENous r\u00e9it\u00e9rons donc notre demande de mettre fin \u00e0 la torture et \u00e0 la n\u00e9gligence m\u00e9dicale de Julian Assange. Nous nous joignons aux principales autorit\u00e9s mondiales en mati\u00e8re de droits de l'homme et de droit international pour demander sa lib\u00e9ration imm\u00e9diate. Il n'est pas possible de traiter les victimes de la torture sans les soustraire au pr\u00e9alable aux circonstances dans lesquelles elles ont \u00e9t\u00e9 tortur\u00e9es. Nous notons que l'IBAHRI a d\u00e9clar\u00e9 que, compte tenu du fait que M. Assange a \u00e9t\u00e9 victime de torture psychologique, son extradition vers les \u00c9tats-Unis serait ill\u00e9gale au regard du droit international des droits de l'homme.\u003C\/p\u003E\u003Cp\u003EUne prise de position de l'Association mondiale de psychiatrie (AMP) souligne que le fait de refuser un traitement m\u00e9dical appropri\u00e9 peut en soi \u00e9quivaloir \u00e0 de la torture (\u003Ca href=\"#nb29\" name=\"nh29\"\u003E29\u003C\/a\u003E). Ainsi, le fait de ne pas traiter correctement M. Assange peut \u00eatre assimil\u00e9 \u00e0 un acte de torture dans lequel des agents de l'\u00c9tat, du parlement au tribunal en passant par la prison, risquent d'\u00eatre jug\u00e9s complices. Au Royaume-Uni, cette complicit\u00e9 est interdite non seulement par la Convention contre la torture, mais aussi par l'article 3 de la Convention europ\u00e9enne des droits de l'homme (CEDH) et par la section 134 de la loi de 1988 sur la justice p\u00e9nale. En vertu de cette derni\u00e8re, tout agent de la fonction publique commet une infraction lorsqu'il \"inflige intentionnellement \u00e0 autrui une douleur ou des souffrances aigu\u00ebs dans l'exercice ou le pr\u00e9tendu exercice de ses fonctions officielles (\u003Ca href=\"#nb31\" name=\"nh31\"\u003E31\u003C\/a\u003E)\".\u003C\/p\u003E\u003Cp\u003EComme l'a indiqu\u00e9 le copr\u00e9sident de l'IBAHRI, l'honorable Michael Kirby AC CMG, le 10 mars 2020\u00a0:\u003C\/p\u003E\u003Cblockquote\u003E\"L'IBAHRI est pr\u00e9occup\u00e9 par le fait que les mauvais traitements inflig\u00e9s \u00e0 Julian Assange constituent des violations de son droit \u00e0 un proc\u00e8s \u00e9quitable et des protections consacr\u00e9es par la Convention des Nations Unies contre la torture et autres peines ou traitements cruels, inhumains ou d\u00e9gradants, \u00e0 laquelle le Royaume-Uni est partie prenante. Il est profond\u00e9ment choquant qu'en tant que d\u00e9mocratie avanc\u00e9e dans laquelle l'\u00c9tat de droit et les droits des individus sont pr\u00e9serv\u00e9s, le gouvernement britannique ait gard\u00e9 le silence et n'ait pris aucune mesure pour mettre fin \u00e0 un comportement aussi flagrant et disproportionn\u00e9 des repr\u00e9sentants de la Couronne. De m\u00eame, nous sommes surpris que le pr\u00e9sident du tribunal n'ait rien dit ni fait pour r\u00e9primander les fonctionnaires et leurs sup\u00e9rieurs pour un tel comportement dans le cas d'un accus\u00e9 dont l'infraction n'est pas une violence physique. De nombreux pays dans le monde consid\u00e8rent la Grande-Bretagne comme un exemple dans ce domaine\".\u003C\/blockquote\u003E\u003Cp\u003ELe Dr Allen Keller, directeur du programme Bellevue\/NYU pour les survivants de la torture, a d\u00e9clar\u00e9 que \"en tant que m\u00e9decins, nous avons un r\u00f4le crucial \u00e0 jouer dans la promotion des droits de l'homme (\u003Ca href=\"#nb32\" name=\"nh32\"\u003E32\u003C\/a\u003E)\", et le professeur Leonard Rubenstein, de l'Institut de bio\u00e9thique John Hopkins Berman, souligne que \"la communaut\u00e9 m\u00e9dicale dans son ensemble doit s'exprimer avec beaucoup plus de force contre la torture (\u003Ca href=\"#nb33\" name=\"nh33\"\u003E33\u003C\/a\u003E)\". Assange pourrait bien faciliter sa mort (\u003Ca href=\"#nb34\" name=\"nh34\"\u003E34\u003C\/a\u003E).
